Are there any specific laws governing adoption in India or any specific criteria for adoption?

In India anyone can adopt, be it a married or single man or woman; whether divorced or widowed. Therefore the marital status of a person doesn’t matter for adoption in India but there are other conditions and qualifications which are as follows –

 

For Males - Any Hindu, who is of sound mind and is not a minor, can adopt a son or daughter with the consent of his wife, if he is married. The consent of the wife becomes immaterial in cases where she ceases to be a Hindu or she has completely renounced the world or if she has been declared to be of unsound mind by a competent court.

 

For Females – Any Hindu (including Buddhist, Jain or Sikh by religion) who is not married, or if married, whose husband is not alive or her marriage has been dissolved or her husband has been declared incompetent by a court to take a son or daughter in adoption.
