The common eviction grounds are:
- Wilful default in rent payment;
- Further subletting by the tenant without prior consent of the landlord;
- Causing nuisance or
- When the landlord himself requires premises for personal occupation
- Damaging the property.
Procedure for eviction of tenant
- First of all the landlord has to give a letter of eviction to the tenant mentioning the reason of his eviction and the time frame till which he has to vacate the property.
- If the tenant doesn’t vacate till the specified time frame then an eviction notice drafted by a lawyer has to be served to the tenant and it should also be pasted on the entrance or some part of the property.
- Lastly the landlord has to take the resort of the competent court under whose jurisdiction the property is situated and file an eviction suit after the payment of relevant court fees.
