Can legal action be taken against FlipKart for misleading consumers on Big Billion Day? Can an appeal be made in the court through the Advertising Standards Council of India, the Consumer Protection Act, or another mechanism?Mentioned below are the steps that should be considered while filing a complaint:
1. Report the Customer Care about the grievance by email and intimate them to resolve the issue within 3 days.
2. If not resolved, write a notice to them stating unfair trade practices and other subject as apply to the case and send them notice under Consumer Protection Act. Write about all the transaction details and grievance in the notice, however it must be ensured that the notice remains formal and to the point. Moreover, inform them how their poor services caused mental harassment and demand compensation to resolve issue within 15-20 days. Wait for another 15-20 days to get the issue resolved and still if it remains unresolved then Consumer Court must be approached.
3. Find VC and Investor of Flipkart and write letter to them for ethical investment.
4. There are many other steps that can be taken including legal or social steps. Also Government or International Organizations can be involved in case to stress on Flipkart to act ethically.
5. Lastly, if no action has been taken by any of the authorities, then Criminal Action under cheating, fraudulent, breach of trust may be initiated, depending upon the merit of the case under section 406, 420 of IPC and section of IT Act (Cyber Crime) may further apply.
